Welcome to Daniel Arpaia Design

By accessing or using this website and its services, you agree to be bound by the following terms. These Terms of Service outline the expectations for collaboration, payment, intellectual property, and more. Please read carefully.

1. Services Provided

Daniel Arpaia Design offers creative direction, graphic design, branding, presentation, and experiential design services. All services and deliverables are defined within a custom estimate and project scope agreed upon by both parties prior to commencement. Any additions or changes to the scope may affect timelines and pricing.

2. Client Responsibilities

You agree to provide timely, accurate information, feedback, and assets necessary to complete your project. Any delays in communication or approvals may affect delivery timelines. You are responsible for ensuring the accuracy and originality of any materials you provide.

3. Payments

All pricing and payment terms are outlined in your estimate and invoice. A 50% deposit is typically required to initiate work, with the remaining balance due upon project completion unless otherwise agreed. Late payments may result in:

  • Suspension of services

  • Late fees (2.5% monthly)

  • Delay in delivery of final assets

Payments are non-refundable once work has commenced, unless otherwise specified in your service agreement.

4. Intellectual Property

Ownership of final deliverables transfers to the client only upon full payment. Prior to full payment, all designs and working files remain the intellectual property of Daniel Arpaia Design.


Unless otherwise agreed in writing:

  • Daniel Arpaia Design retains the right to showcase completed work in its portfolio, presentations, and marketing channels.

  • Working files, concepts, or unused designs are not included in final deliverables unless explicitly stated in the estimate.


Stock photography, fonts, and third-party assets may be licensed separately and may not be sub-licensed or redistributed.

5. Project Scope & Revisions

Each project includes a clearly defined number of revisions and deliverables as outlined in your estimate. Any requests beyond the original scope will be billed at an hourly rate or flat fee, subject to mutual agreement.

6. Confidentiality & Privacy

Any proprietary or confidential information shared during the course of a project will be treated with care and discretion. Daniel Arpaia Design agrees not to disclose or share private project details with outside parties unless required by law or with written consent.

7. Use Restrictions

You agree not to:

  • Use provided services for unlawful or unethical purposes.

  • Resell or redistribute deliverables without written permission.

  • Claim ownership over preliminary concepts or drafts not selected.

8. Termination

Either party may terminate a project at any time with written notice. In the event of termination:

  • All completed work to date will be invoiced.

  • Partial deliverables may be provided based on work paid for.

  • All outstanding balances must be settled within 10 business days.

Daniel Arpaia Design reserves the right to discontinue services for non-payment or breach of terms.

9. Liability Disclaimer

While every effort is made to ensure high-quality, error-free deliverables, Daniel Arpaia Design is not liable for:

  • Consequential damages due to misuse or third-party alterations.

  • Performance of external platforms or systems (e.g., web hosts, printers).

  • Delays caused by client inactivity or unresponsiveness.

10. Updates to Terms

These terms may be updated periodically. Continued use of services after updates signifies your acceptance of the revised terms. The most current version will always be available on this site.
